Welcome to Biomagna Pro® ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, the purchase of our hardware, and your enrollment in our guided protocols.

By accessing our website or purchasing a Biomagna Pro® device, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are prohibited from using this site or purchasing our products.

1. Eligibility & Safety Disclaimer

Age Requirement: You must be at least 18 years old to purchase our products or use this website.

General Wellness Disclaimer: Biomagna Pro® is a general wellness device designed for personal cognitive support, focus enhancement, and relaxation. It is not a medical device and is not designed, intended, or cleared to diagnose, treat, prevent, or cure any clinical, medical, physical, or mental health condition.

User Responsibility: You should consult with a healthcare professional before beginning any new wellness protocol, especially if you have pre-existing medical conditions, utilize implants (such as pacemakers), or are pregnant.

2. Purchase, Billing, and Third-Party Financing

Payment Authorization: By placing an order, you authorize us to charge your selected payment method for the full purchase price of the device and any associated shipping fees or taxes.

Third-Party Financing: We partner with third-party payment providers (including Shopify Payments, Affirm, Klarna, and Afterpay) to offer installment plans. Your use of these services is subject to the respective third party's terms and privacy policies.

3. Protocol Access Programs & Device Return Requirements

Your purchase includes access to one of our structured protocol programs (30-Day, 60-Day, 90-Day, or 120-Day Access). Because the Biomagna Pro® device is a premium hardware allocation linked directly to these protocols, the following terms apply upon completion of your program:

Return Obligation: Upon the expiration of your selected protocol access period, your program ends, and you must return the physical Biomagna Pro® hardware to our facility.

The 3-Day Grace Period: You must initiate and ship your return package within three (3) business days of your protocol’s scheduled completion date. You must provide valid tracking information to contact@biomagna-pro.com.

Extended Protocol & Maintenance Fee: If the device is not returned or shipped back within the 3-business-day grace period, you agree and authorize us to charge an Extended Protocol & Maintenance Fee of $79.00 USD per month to your payment method on file.

Recurring Billing: This $79.00 USD fee will automatically recur monthly and is non-refundable. Charges will cease only once the device is safely received, inspected, and processed at our warehouse.

4. Satisfaction Guarantee, Returns, and Restocking Fees

30-Day Window: We offer a 30-day satisfaction guarantee starting from the day your device is delivered.

15% Restocking Fee: To cover the essential hygiene, testing, recalibration, and repackaging of returned devices, all eligible returns are subject to a 15% restocking fee, which will be deducted from your final refund.

Return Conditions: Devices must be returned in their original, like-new physical condition with all original packaging, manuals, charging cables, and accessories. We reserve the right to deny refunds for devices that show signs of physical abuse, water damage, or unauthorized tampering.

Shipping Costs: The customer is responsible for all return shipping costs. We strongly recommend using a tracked, insured shipping service. We are not responsible for packages lost in transit.

5. Hardware Warranty

Your hardware is protected under our dual-tier warranty policy, which covers manufacturing defects under normal use:

Standard 120-Day Warranty: Automatically included with all purchases, starting from the delivery date.

1-Year Extended Care Warranty: Active only for clients who remain enrolled in our ongoing Active Care Program (our support and protocol guidance membership) beyond their initial protocol duration.

Exclusions: The warranty does not cover damage caused by accident, neglect, physical dropping, liquid exposure, or unauthorized modification.

6. Intellectual Property & Prohibited Uses

Proprietary Rights: All content on this site, including text, graphics, logos, images, software, and the design of the Biomagna Pro® device, is the exclusive property of Biomagna Pro® and is protected by intellectual property laws.

Reverse Engineering Prohibited: You agree not to reverse engineer, disassemble, decompile, copy, or attempt to replicate the hardware, software, or frequency protocols of the Biomagna Pro® device.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Biomagna Pro®, its directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of productivity, cognitive disruption, personal injury, or financial loss arising from your use of, or inability to use, the device.

8. Governing Law & Dispute Resolution

These Terms and any dispute arising out of your use of our website or products shall be governed by and construed in accordance with the laws of Florida, United States of America, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Miami, FL.
